Carlene M. Craig, Leo Rittenhouse, Jeff Bramlage, Lawrence
Liable, and Kent Whistler, Appellants, v. FedEx Ground Package
System, Incorporated, No. 108,526 (Kan.).

FedEx Ground Package System, Inc. misclassified its
delivery truck drivers as independent contractors, the
Supreme Court of the State of Kansas said, holding
that FedEx drivers are employees as a matter of law
under the Kansas Wage Payment Act, K.S.A. 44-313 et
seq., and a plaintiff driver does not lose his or her
employee status by acquiring another route for which
that plaintiff is not the driver.  Given that the
certified class only includes full-time drivers, the
Kansas Supreme Court declined to opine on a driver's
status with respect to any assigned service area for
which he or she is not a full-time driver.

Dart Cherokee Basin Operating Company, LLC, et al., Petitioners,
v. Brandon W. Owens, No. 13-719 (U.S.)

The U.S. Supreme Court decided, 5-4, that when a
plaintiff's complaint does not state the amount in
controversy, the defendant's notice of removal may do
so, and the defendant need not incorporate into the
removal notice any evidentiary support.  The Supreme
Court reversed the opinion of the U.S. Court of Appeals
          for the Tenth Circuit.

Brandon W. Owens filed a putative class action in Kansas
state court alleging that Dart Cherokee Basin Operating
Company, LLC, and Cherokee Basin Pipeline, LLC underpaid
royalties owed to putative class members under certain
oil and gas leases.  The plaintiffs did not seek a
specific damage amount, but Dart Cherokee claimed it
          would far exceed $5 million.

          Decided: December 15, 2014

Hon. Justice Ruth Bader Ginsburg delivered the opinion,
in which the Hon. Chief Justice John Roberts and the
Hon. Justices Stephen Breyer, Samuel Alito, and Sonia
Sotomayor joined.  The Hon. Justice Antonin Scalia
filed a dissenting opinion, in which the Hon. Justices
Anthony Kennedy and Elena Kagan joined, and in which
the Hon. Justice Clarence Thomas joined as to all but
the final sentence.  Justice Thomas filed a dissenting
          opinion.

Halliburton Co., et al., Petitioners v. Erica P. John Fund,
Inc., fka Archdiocese of Milwaukee Supporting Fund, Inc., No.
13-317 (U.S.).

The U.S. Supreme Court agrees with Halliburton that
defendants should at least be allowed to defeat the
presumption at the class certification stage through
evidence that the misrepresentation did not in fact
affect stock price.  In doing so, the Supreme Court
overturned the presumption of reliance in Basic Inc.

          194 (1988).

Sec. 78j(b), and Securities and Exchange Commission Rule
          10b-5, 17 CFR Sec. 240.10b-5 (2013).

Mississippi, ex rel. Jim Hood, Attorney General, Petitioner
v. AU Optronics Corporation, et al., No. 12-1036 (U.S.)

The U.S. Supreme Court, in a unanimous decision,
reversed a ruling by the U.S. Court of Appeals for the
Fifth Circuit, holding that the "mass action" provision
under the Class Action Fairness Act did not provide for
jurisdiction over a parens patriae suit filed by the
attorney general of Mississippi.  Because the State of
Mississippi is the only named plaintiff in the action,
the case must be remanded to state court.

The State of Mississippi sued manufacturers of liquid
crystal displays in state court, alleging they had
formed an international cartel to restrict competition
and raise prices in the LCD market.

          Decided: January 14, 2014

Hon. Justice Sonia Sotomayor delivered the opinion.

Pamela Harris et al., Petitioners v. Pat Quinn, Governor
of Illinois, et al., No. 11-681 (U.S.)

The case presents the question whether the First
Amendment permits a State to compel personal care
providers to subsidize speech on matters of public
concern by a union that they do not wish to join or
support.  The U.S. Supreme Court holds that it does
not, and reversed the judgment of the Court of Appeals.

          Decided: June 30, 2014

Hon. Justice Samuel Alito delivered the opinion, in
which Hon. Chief Justice John Roberts, and Justices
Antonin Scalia, Anthony Kenney, and Clarence joined.
Hon. Justice Elena Kagan filed a dissenting opinion,
in which Justices Ruth Bader Ginsburg, Stephen Breyer,

Vivendi Canada Inc. v. Dell'Aniello, 2014 SCC 1, [2014] 1
S.C.R. 3

The Supreme Court of Canada addresses the scope of the
criteria for the authorization of class actions, in
particular the criterion of identical questions of
fact and law set out by article 1003(a) of the Code of
Civil Procedure (CCP).  According to the Supreme Court,
the fact that members of the group live in different
Canadian provinces should not prevent the court from
authorizing the class action, given that it can accept
proof of the law applicable in the common law provinces
or take judicial notice of that law.  Only substantial
differences between the applicable legal schemes would
cause the action to lose its collective nature.
