ANTHEM COMPANIES: Court Stays Lazaar Suit Pending Mediation

In the class action lawsuit captioned as Lazaar, et al. v. The
Anthem Companies, Inc., et al., Case No. 1:22-cv-03075-JGLC
(S.D.N.Y.), the Hon. Judge Jjessica G. L. Clarke entered an order
granting joint status letter and letter-motion to stay proceedings
pending mediation.

-- The case is stayed pending mediation.

As detailed in the parties' June 28, 2024, joint status letter, the
parties’ conferrals over the past month regarding mediation of
this case and some or all of the related cases remained ongoing.

The Court endorsed the parties' status letter and ordered the
parties to file another joint status letter regarding the progress
of their settlement discussion efforts no later than July 8, 2024.


Since that time, the parties have selected a mutually agreeable
mediator and mediation date. The parties now ask the Court to stay
this case pending mediation.

In light of the parties' ongoing discussions regarding settlement
over the past month and the related importance of limiting
litigation expenses, the parties have jointly agreed to wait to
conduct remaining discovery until after mediation, if needed.

This includes Plaintiffs' 30(b)(6) deposition of Defendants’
corporate representative, outstanding opt-in Plaintiff depositions,
and outstanding document production from Defendants.

Should the case not resolve, the parties agree that Defendants will
complete their document production no later than November 6, 2024,
14days after mediation.

The parties also agree that Plaintiffs’ 30(b)(6) deposition of
Defendants’ corporate representative and outstanding opt-in
Plaintiff depositions will be completed no later than November 13,
2024.

As such, the parties request that the Court grant the Motion and
stay these proceedings from the date of the filing of this Motion
through November 6, 2024.

The parties agree to submit a modified scheduling order to cover
litigation through trial, if needed, no later than Nov. 13, 2024.

GRAPHIC PACKAGING: Class Settlement in Roberts Gets Final Nod
-------------------------------------------------------------
In the class action lawsuit captioned as JOCELYN ROBERTS,
individually and on behalf of all others similarly situated, v.
GRAPHIC PACKAGING INTERNATIONAL, LLC, Case No. 3:21-cv-00750-DWD
(S.D. Ill.), the Hon. Judge David Dugan entered an order granting
the motion for final approval of the Class Action Settlement and
the Motion for Attorneys' fees, costs, and service award.

The Parties are granted 90 days to conclude the settlement and
distribution of all funds.

The Clerk of Court is directed, 90 days after this Order is
docketed, to dismiss the case in its entirety and enter judgment
accordingly.

Accordingly, Class Counsel are hereby awarded $354,505.76 for
attorney fees and $9,397.31 for reimbursed expenses from the
balance of the Settlement Fund, and which amount shall be paid to
Class Counsel from the Settlement Fund in accordance with the terms
of the Agreement.

Class counsel details various efforts by Roberts to assist the
prosecution of this case on behalf of the class. For these reasons,

Inc., Case No. 9:24-cv-80279 (S.D. Fla., Filed March 12, 2024), the

response to pending motion for conditional class certification.

The Plaintiff filed a Motion for Conditional Class Certification on
March 21, 2024.

HEALTHCARE REVENUE: Loses Bid to Narrow Class Definition
--------------------------------------------------------
In the class action lawsuit captioned as MORALES v. HEALTHCARE
REVENUE RECOVERY GROUP, LLC et al., Case No. 2:15-cv-08401 (D.N.J.,
Filed Dec. 2, 2015), the Hon. Evelyn Padin Judge entered an order
denying the Defendant's request to narrow the class definition to
potential claimants/patients who were seen at the same
billing/service location as the named Plaintiff and Plaintiff's
response.

The Court will deny the request for the following reasons. As an
initial matter, the Court notes that this is Defendant's first
objection to the class definition; Defendant did not, in its
opposition to Plaintiff's class certification motion, raise this
issue.

Rather, as the Court noted in its Opinion granting class
certification and establishing the class definition, Defendant
simply engrafted its standing arguments, already rejected by the
Third Circuit, onto its class analysis. According to Defendant, it
had no reason to object to the class definition until "after
receiving the Court's expansive class definition."

The decision to amend a class certification order is discretionary,
and there is no requirement that a court alter its class action
order when the circumstances surrounding its initial determination
change.

At that point, it "compiled a listing of all patients seen at any
EPANJ billing and service location, whose accounts were placed with
HRRG for collections, regardless of whether these patients were
seen at the EPANJ billing and service location where Plaintiff was
treated."

But in fact, as Plaintiff highlights, Plaintiff's initial
interrogatories and document production requests should have
revealed that same list, or perhaps an even broader list.

However, Defendant does not explain which "facts" justify
amendment, or that a higher administrative burden alone justifies
amendment. But more importantly, the crux of this case is not the
location at which Plaintiff (or any other patient) was seen, but
the manner in which billing occurred -- and there is no indication
that other locations utilized different billing/notification
practices.

Thus, narrowing the class could actually defeat the purpose of
class action procedure, the lawsuit says.

The nature of suit alleges violation of the Fair Debt Collection
practices Act involving consumer credit.[CC]

company which charged LuLu's tipped employees to receive their tips

"SCPWA", in particular by violation of section 41-10-40(c) by
unlawful withholding or diverting portions of the employee's wages.


The Defendants deny that they violated the FLSA and SCPWA in any
respect.

The parties agreed that this case should be certified as a
collective action and class action whose class members will be
composed of:

      "Any server and/or bartender employed at Lulu's from Dec. 2,

      2018, through March 15, 2024, who participated in the tip
pool
      created by LuLu's."

The parties have agreed that the Plaintiffs can maintain a
collective action for unpaid wages on behalf of themselves and
"similarly situated employees" under the FLSA pursuant to 29 U.S.C.
216(b). Furthermore, the parties have agreed that the Plaintiffs

Rules of Civil Procedure on behalf of themselves and "similarly

RESTORATION BUILDERS: Harrison Suit Seeks to Certify Employee Class

In the class action lawsuit captioned as SEAN HARRISON and ELIJAH
MUHM on behalf of themselves and a class of those similarly
situated, v. RESTORATION BUILDERS, INC., Case No. 2:24-cv-00240
(N.D. Ind.), the Plaintiffs ask the Court to enter an order
certifying the class defined as:

    "all persons who worked as sales employees residing in the
State
    of Indiana for RBI in 2023 and who are no longer employed by
RBI
    as of June 1, 2024."

All requirements for class certification are readily met here, and
the class should accordingly be certified.

The Plaintiffs are all sales employees who worked as sales
employees residing in the State of Indiana for RBI whose "claims
have the same essential characteristics as the claims of the class
at large."

All putative class members, including future class members, are
affected by this. All would benefit from a judgment favorable to
the plaintiffs in this case. Their claims are typical of those of
the class they seek to represent.
