YPF SOCIEDAD: Moody's Withdraws 'Ba2' Rating on US$300-Mil. Notes

Moody's Investors Service commented that YPF Sociedad Anonima's
Ba1 global local currency rating and Aaa.ar National Scale Rating
on its bank line with Banco de la Nacion remain unchanged. "We
note the bank line has been increased to up to US$200 million or
ARS equivalent from US$150 million or ARS equivalent. T he credit
line with BNA is uncommitted and ranks pari passu with YPF's other
senior unsecured debt. The outlook for the ratings is stable,"
Moody's said.
At the same time, Moody's withdrew the Ba2 foreign currency bond
rating and Aaa.ar National Scale rating assigned to YPF's proposed
issuance of US$300 million of medium-term notes. This action
follows YPF's postponement of the proposed transaction.
YPF Sociedad Anonima is the largest energy company in Argentina.
It is headquartered in Buenos Aires.

BERNARD L. MADOFF: Maxam Suit in Caymans Found to Violate Stay
--------------------------------------------------------------
Bill Rochelle, the bankruptcy columnist for Bloomberg News,
reports that Maxam Absolute Return Fund Ltd. was found in
violation of the automatic bankruptcy stay for commencing a
lawsuit in the Cayman Islands to declare that the fund has no
obligation to return US$25 million to the trustee for Bernard L.
Madoff Investment Securities LLC.
Bloomberg relates that U.S. Bankruptcy Judge Burton R. Lifland
ruled in a 21-page opinion on Oct. 12 that the Cayman Islands
lawsuit was a "blatant attempt to hijack the key issues to another
court for determination."
According to Mr. Rochelle, the dispute traces its roots to
December, when the Madoff trustee sued the Maxam fund as the
subsequent recipient of US$25 million taken out of the Madoff firm
within 90 days of bankruptcy. In July, on almost the same day it
answered the complaint in bankruptcy court, Maxam filed suit in
the Cayman Islands seeking a declaration that there is no
liability to return the US$25 million, Judge Lifland said in his
opinion.
Judge Lifland, Mr. Rochelle discloses, ruled that the suit in the
Cayman Islands was "void ab initio," meaning it was a nullity from
the very beginning and nothing that happened in the case gave the
Maxam fund any rights that could be enforced in the U.S. The
bankruptcy judge directed Maxam to withdraw and dismiss the suit
in the Cayman Islands by Oct. 14. If Maxam obeys and stops the
Cayman Islands suit, Judge Lifland said he won't assess sanctions
or damages against Maxam for violating the automatic stay.
The automatic stay is part of U.S. Bankruptcy Law that halts all
court or other proceedings against a bankrupt party or its
property outside of bankruptcy court.
About Bernard L. Madoff
Bernard L. Madoff Investment Securities LLC and Bernard L. Madoff
orchestrated the largest Ponzi scheme in history, with losses
topping US$50 billion. On Dec. 15, 2008, the Honorable Louis A.
Stanton of the U.S. District Court for the Southern District of
New York granted the application of the Securities Investor
Protection Corporation for a decree adjudicating that the
customers of BLMIS are in need of the protection afforded by the
Securities Investor Protection Act of 1970. The District Court's
Protective Order (i) appointed Irving H. Picard, Esq., as trustee
for the liquidation of BLMIS, (ii) appointed Baker & Hostetler LLP
as his counsel, and (iii) removed the SIPA Liquidation proceeding
to the Bankruptcy Court (Bankr. S.D.N.Y. Adv. Pro. No. 08-01789)
(Lifland, J.). Mr. Picard has retained AlixPartners LLP as claims
agent.
On April 13, 2009, former BLMIS clients filed an involuntary
Chapter 7 bankruptcy petition against Bernard Madoff (Bankr.
S.D.N.Y. 09-11893). The case is before Hon. Burton Lifland. The
petitioning creditors -- Blumenthal & Associates Florida General
Partnership, Martin Rappaport Charitable Remainder Unitrust,
Martin Rappaport, Marc Cherno, and Steven Morganstern -- assert
US$64 million in claims against Mr. Madoff based on the balances
contained in the last statements they got from BLMIS.
On April 14, 2009, Grant Thornton UK LLP as receiver placed Madoff
Securities International Limited in London under bankruptcy
protection pursuant to Chapter 15 of the U.S. Bankruptcy Code
(Bankr. S.D. Fla. 09-16751).
The Chapter 15 case was later transferred to Manhattan. In June
2009, Judge Lifland approved the consolidation of the Madoff SIPA
proceedings and the bankruptcy case.
Judge Denny Chin of the U.S. District Court for the Southern
District of New York on June 29, 2009, sentenced Mr. Madoff to
150 years of life imprisonment for defrauding investors in United
States v. Madoff, No. 09-CR-213 (S.D.N.Y.)
As of July 15, 2011, a total of US$6.88 billion in claims by
investors has been allowed, with US$794.9 million to be paid by
the Securities Investor Protection Corp. Investors are expected
to receive additional distributions from money recovered by Mr.
Picard from lawsuits or settlements.

* DOMINICAN REPUBLIC: Awaits US$380 Million in Loans From IMF

Dominican Today reports that the Dominican Republic will receive
US$380 million from the international entities once the
International Monetary Fund mulls the Letter of intent on the
seventh revision of the Standby agreement signed in 2009.
Dominican authorities said that the IMF is expected to analyze the
document, according to Dominican Today.
The report relates that of those funds US$170 million will be from
the IMF as part of the US$510 million which the country should
receive during the rest of the year, while US$210 million more are
from the World Bank and the Inter-American Development Bank (IDB).
All those funds are consigned in the national Budget.
Dominican Today relates that Dominican Republic President Luis
Alberto Moreno said IDB will also provide the country a total of
US$360 million in credits this year. The report relays Mr.
Moreno added that the amount of money provided for the country is
much higher than Dominican Republic's payments to the IDB.

INTERTRADE FINANCE: FSC Says Firm is Insolvent Based on Records

RJR News reports that the Financial Services Commission said,
after examining company records, that Intertrade Finance
Corporation is insolvent.
The first red flag was raised when Intertrade Finance was late in
submitting its financial statements to the regulator, according to
RRJ News. At that time however, the company denied it was in
trouble and said failure to submit the document on time was not a
sign that the company was in any trouble, the company relates.
RJR News notes that FSC said it found that the company had as much
as JM$3.6 billion in liabilities owed to creditors, investors,
employees, utility providers and tax authorities. The figure does
not include fees that have been incurred by the FSC during its
period of temporary management, RJR News says.
The report discloses that the company's assets that were
identified to cover all the claims made against the company were
woefully inadequate at only JM$1.1billion.
Meanwhile, RJR News relates that already in a separate court
proceeding, two institutional clients of Intertrade have had their
assets frozen. The report relates that the regulator said it has
filed a petition to wind up the company, presumably to sell any
assets it can get its hands on, to meet the demands.
As reported in the Troubled Company Reporter-Latin America on
May 27, 2011, RJR News said that restrictions have been placed on
the operations of Intertrade Finance after it was served with a
cease and desist order by the Financial Services Commission. The
order was issued to Joan Powell, Intertrade's Chief Executive
Officer and its Directors Gavin Chen, Christopher Malcolm and
Herbert Malcolm, according to RJR News. The report related that
FSC said the order was based on the company misrepresenting
clients on the nature of the securities in which they had
invested, its failure to pay over sums to certain clients in
keeping with their instructions, and a review of its interim
financial statements and other documents.

prices for bond issues that reportedly trade well below par.
Prices are obtained by TCR-LA editors from a variety of outside
sources during the prior week we think are reliable. Those
sources may not, however, be complete or accurate. The Monday
Bond Pricing table is compiled on the Friday prior to publication.
Prices reported are not intended to reflect actual trades. Prices
for actual trades are probably different. Our objective is to
share information, not make markets in publicly traded securities.
Nothing in the TCR-LA constitutes an offer or solicitation to buy

insolvent balance sheets obtained by our editors based on the
latest balance sheets publicly available a day prior to
publication. At first glance, this list may look like the
definitive compilation of stocks that are ideal to sell short.
Don't be fooled. Assets, for example, reported at historical cost
net of depreciation may understate the true value of a firm's
assets. A company may establish reserves on its balance sheet for
liabilities that may never materialize. The prices at which
equity securities trade in public market are determined by more
than a balance sheet solvency test.
